Liability Release Waiver And Indemnification

Mister John’s Music and any HOSTING LOCATION used cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while participating in Mister John’s Music’s services or programs. It is not possible to prevent the presence of the disease. Therefore, if you choose to participate in Mister John’s Music’s in-person services or programs, outdoors or indoors, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. Therefore, Mister John’s Music or all Hosting Locations need to assure that you agree to waive and indemnify against any claims against them arising from you and your child/children arising from COVID19.

ASSUMPTION OF RISK:
I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to participate in Mister John’s Music’s services or programs.  These services or programs are of such value to me [and/or to my child(ren,)] that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to participate in the service or program.

WAIVER OF LAWSUIT/LIABILITY AND INDEMNIFICATION:
I hereby forever release and waive my right to bring suit against Mister John’s Music and any HOSTING LOCATION, and the owners, officers, directors, managers, officials, trustees, agents, and employees, or other representatives of such entities in connection with exposure, infection, and/or spread of COVID-19 related to participation in the Mister John’s Music’s services or programs. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. Furthermore, I hereby agree to indemnify and hold harmless Mister John’s Music and any Hosting Location, and the owners, officers, directors, managers, officials, trustees, agents, and employees, or other representatives of such entities, from any and all claims of damages from Covid-19 arising from participation of me, my family and employees in such programming.

CHOICE OF LAW:
I understand and agree that the law of the State of Pennsylvania will apply to this agreement.

By purchasing a Mister John’s Music class, I am agreeing that participation in the aforementioned is voluntary, that I assume the risk associated with exposure to Covid-19 by participation in a public gathering, and agree to waive any and all liability against Mister John’s Music and HOSTING LOCATION,  and any of its officers and employees for exposure to Covid-19, as fully described in the foregoing Waiver of Liability and Indemnification statement.
